Galleria Italia is owned and operated by Galleria Italia Pty Ltd (ABN 53 687 436 960). In these Terms and Conditions of Sale, "we", "us", and "our" refer to Galleria Italia Pty Ltd. These Terms and Conditions apply to all purchases made through our online store, by phone, or directly in-store, including pick-up orders.
All prices listed are in Australian Dollars (AUD) and include Goods and Services Tax (GST), unless otherwise stated. When you place an order with us, it is considered an offer to purchase our products. We accept your order when we issue an order confirmation or dispatch the goods.
For custom-made products, including custom kitchens, custom aluminum-framed glazed windows and doors, and any made-to-order furniture, a non-refundable deposit, as specified on your quote or invoice, is required upon confirmation of the order. Production or procurement of these goods will commence only after your deposit has been cleared in our account.
Ownership of goods transfers to you once full payment is received. The risk associated with the goods passes to you at the point of delivery or when you collect the goods. We reserve the right to correct clerical errors in our documents. If a material pricing error is discovered after you have placed an order, we will contact you to offer the choice of proceeding at the corrected price or canceling the order for a full refund.
Natural materials such as timber, rope, stone, and fabrics inherently display variations in grain, texture, and color. Please note that colors may appear differently on screens or displays compared to the actual product finishes. All product dimensions provided are approximate, and reasonable tolerances apply.
It is your responsibility to ensure there is adequate access for delivery or installation. If access is insufficient, additional charges for redelivery, return freight, and/or restocking may apply.
We offer delivery services Australia-wide for all product categories except decking floors and wall cladding, which are generally available for pick-up or arranged delivery through one of our third-party providers, due to their bulk and handling requirements. However, Australia-wide freight for all other products is available at the published rate shown on the respective product pages. Our standard delivery service is curbside only; assembly, installation, and rubbish removal are not included unless otherwise quoted.
Upon delivery, please inspect the packaging for any visible damage and note this on the carrier's docket. For concealed damage, you must notify us within 48 hours and provide photographs so we can assist with a carrier claim and resolve the issue. (This timing does not affect your rights under the Australian Consumer Law.) If you choose to collect your goods, you are responsible for loading, securing, and safely transporting them.
If delivery or collection cannot be completed within 20 business days after we notify you that your goods are ready, we may apply storage fees.
Products that require installation must be installed strictly according to our installation guides and all relevant Australian Standards. For window and door products, this includes compliance with AS 2047 and AS 1288. Failure to follow these guidelines may void any limited warranties provided with the product.
For custom aluminum windows and doors, it is essential that your site complies with National Construction Code (NCC) requirements, including wind rating and glazing specifications. In some cases, installer certification may be required to ensure compliance.
For stock items, if you wish to cancel your order prior to dispatch, we will make reasonable efforts to do so. However, if the item has already been handed over to the carrier, cancellation fees may apply. For custom-made items, once production has commenced, orders cannot be canceled. Deposits and any supplier costs incurred will be retained to cover our costs.
Your purchase is protected by the non-excludable consumer guarantees provided under the Australian Consumer Law (ACL). If the goods fail to meet these guarantees, you are entitled to a repair, replacement, refund, or compensation, depending on the nature of the failure. Any limited warranties we offer are in addition to your rights under the ACL. Please refer to the Warranty document for details specific to each product category.
To the extent permitted by law, and for purchases not ordinarily for personal, domestic, or household use, our liability is limited, at our discretion, to repairing or replacing goods, supplying equivalent goods, or paying the cost to do so. Nothing in these Terms limits your rights under the Australian Consumer Law. We are not liable for delays beyond our control or for any indirect or consequential loss.
We are not liable for any delay or failure to fulfil our obligations caused by events beyond our reasonable control, such as strikes, port congestion, extreme weather events, or pandemic restrictions.
These Terms and Conditions are governed by the laws of New South Wales, Australia. The courts of New South Wales have non-exclusive jurisdiction over any disputes arising from these Terms.
